This guide to the RIBA Domestic Building Contract and the RIBA Concise Building Contract is the latest title from Sarah Lupton, best-selling author of contract guides.

It covers all aspects of the RIBA Building Contracts including the reasons for choosing these forms, the legislative background, and highlights the recent innovations in these new contracts from the RIBA.

Written in simple language to complement the RIBA Building Contracts, the guide assumes only general knowledge of both RIBA Building Contracts. A short list of further sources of information is given at the end of each chapter on subjects such as health and safety and so this guide can be used by both the architect and construction students on the threshold of undertaking their professional examinations. It also serves as an invaluable desktop reference guide for the busy contract administrator.
Chapter 1: Introduction - Background, key features and differences between the forms, outline comparison with other forms.

Chapter 2: When to use the forms - Application of Housing Grants Act etc., definition of 'residential occupier' - Consumer protection legislation, explanation of a 'consumer' client, implications for projects. - Procurement route and risks distribution - Implications of client occupation or otherwise - Indemnification and insurance arrangements

Chapter 3: Forming the contract - Tender processes, alternative procedures with these forms - Information that must be included in tender documents, checklist of decisions required by client - Preparing the contract: the form, and possible accompanying documents - Priority of documents; supplementary information, incorporation by reference, interaction between this and express terms

Chapter 4: Roles of the parties - Key duties and responsibilities (outlined and tabulated), including statutory duties - Administrator's main obligations and role - Contractor's main obligations including standard of work - Contractor design obligations, handling of information, e.g. shop drawings - Client involvement, rights and procedures.

Chapter 5: Project Progress - The programme, starting, progress, delays, extensions of time.

Chapter 6: Payment and certification - Contract sum, what work must be provided for the sum - Payments in advance - Off-site and unfixed goods - Progress payments, certification, notices - Non-payment and its implications

Chapter 7: Completion and post completion - Procedures at completion - Post completion, dealing with defects

Chapter 8: Problems and disputes - Breach of contract, summary of measures that can be taken - Termination - Dispute handling and resolution
